Terms of Service

1. Service Overview

BrightBe One is an online platform that connects students (through their parents/guardians) with independent tutors for 1-on-1 online lessons. The service is operated by Mercy Global Education LLC ("Company", "we", "us").

By using our service, you agree to these Terms of Service. If you do not agree, please do not use the service.

2. Account Registration

For parents/guardians:

• You must be at least 18 years old
• You must provide accurate, current information
• You are responsible for all activity under your account
• You must obtain parental consent for any child under 13 you register

For tutors:

• You must be at least 18 years old
• You must complete our application and verification process
• You must provide accurate professional and identity information
• You may not transfer your account to others

3. Tutor Responsibilities

As an independent contractor on our platform, you agree to:

• Provide professional, ethical tutoring services
• Maintain the qualifications represented in your application
• Communicate professionally with students and parents
• Show up on time for scheduled lessons
• Comply with all applicable laws and tax obligations in your jurisdiction
• Not solicit students to take lessons outside the platform
• Not share student information outside of providing tutoring services
• Report any safety concerns immediately

4. Parent/Student Responsibilities

• Provide a safe, appropriate environment for lessons
• Be present or available during lessons with young children
• Treat tutors respectfully
• Pay for scheduled lessons in accordance with our cancellation policy
• Not record lessons without tutor consent
• Not solicit tutors to teach outside the platform

5. Payments & Fees

Lesson rates: Tutors set their own hourly rates. Most charge between $30 and $100 per hour. Rates are displayed on each tutor's profile.

Platform commission: BrightBe One charges a 35% commission on each completed lesson. The tutor receives 65% of the lesson fee.

Example: For a $60/hour lesson, the parent pays $60. The tutor receives $39. BrightBe One retains $21 to cover platform operations, marketing, payment processing, customer support, and infrastructure.

Payment processing: Payments are processed by Stripe. By using our service, you agree to Stripe's terms.

Tutor payouts: Payouts are issued weekly or monthly via the payment method the tutor selects (PayPal, Wise, or bank transfer where available).

Taxes: Tutors are independent contractors and are responsible for their own tax filings. We do not withhold taxes.

6. Cancellation & Refunds

Lesson cancellation by parent/student:

• More than 24 hours before lesson: Full refund
• Within 24 hours: Subject to tutor's individual policy
• No-show: Charged full lesson fee

Lesson cancellation by tutor: Lessons cancelled by tutors are fully refunded. Repeated cancellations may result in account suspension.

Service issues: If a lesson cannot proceed due to platform issues, contact us at hello@brightbelearning.com.

7. Intellectual Property

All content on the BrightBe One platform (excluding user-generated content) is owned by Mercy Global Education LLC and protected by copyright and other intellectual property laws.

User-generated content: Tutors retain ownership of their profile content, intro videos, and lesson materials, but grant BrightBe One a license to display and distribute them on the platform.

8. Prohibited Conduct

• Misrepresent your identity, qualifications, or experience
• Use the platform for any unlawful purpose
• Harass, abuse, or harm other users
• Share inappropriate content, especially involving children
• Attempt to gain unauthorized access to the platform
• Use automated tools without permission
• Solicit users to take lessons outside the platform
• Violate any applicable laws

9. Disclaimers & Liability

Service "as is": The service is provided "as is" without warranties of any kind, except where required by law.

Tutor independence: Tutors are independent contractors, not employees. BrightBe One screens tutors but does not guarantee their teaching outcomes.

Limitation of liability: To the maximum extent permitted by law, our liability is limited to the total amount you paid us in the 6 months before the issue arose.

10. Termination, Changes & Contact

Account termination: You may close your account at any time. We may suspend or terminate accounts for violations of these Terms.

Changes to Terms: We may update these Terms. Material changes will be notified. Continued use after changes means acceptance.

Governing law: These Terms are governed by the laws of the State of Florida, USA.
